TERMS OF SERVICE

1. Introduction and Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you and House And Land Packages Pty Ltd (ABN 92 631 641 408) ("HALP"). By accessing or using any of our websites, platforms, or services, you agree to be bound by these Terms and our Privacy Policy. For Advertisers, the Listing Agreement is incorporated by reference and prevails on listing specifics.

These Terms apply to halp.com.au, boutiquedevelopments.com.au, related websites, mobile applications, and all HALP network platforms. You must be at least 18 years of age.

We may modify these Terms at any time. Material changes will be notified by email (for registered users) and prominently displayed on our websites. Continued use after posting constitutes acceptance.

2. Description of Services

HALP operates property discovery and business directory platforms — property listings, house & land packages, off-the-plan and new developments, school zone integration, mortgage broker connections, market data, and professional business listings with lead generation.

HALP is an information and advertising platform — not a real estate agent, developer, builder, or financial advisor. Property listing inquiries go directly to the advertiser; HALP is a technology conduit. Platform inquiries (Contact Us, Join Us, Advertise With Us) are handled by HALP under our Privacy Policy.

Services are provided "as is" and "as available". Our infrastructure includes AWS, Synergywholesale, Google Workspace, Stripe, Pipedrive, ActiveCampaign, and Zapier — these may change over time.

3. User Accounts and Registration

You must provide accurate information, keep credentials confidential, be at least 18, and only create one account per person. Business accounts require a valid ABN/ACN. You are responsible for all activity under your account and must notify us of unauthorized access. We may suspend or terminate for breach, false information, fraud, non-payment, or extended inactivity.

4. User Conduct and Prohibited Activities

You agree to comply with laws, use services for lawful purposes, provide truthful information, and respect IP rights. You must not: use bots or scrapers without permission; interfere with the platform; upload malware; spam or phish; impersonate others; violate laws or IP rights; harass or discriminate; or resell/redistribute our services.

Violations may lead to account suspension or termination, content removal, legal action, and reporting to authorities.

5. Property Listings and Information

Property listings are third-party content owned by developers, builders, and agents. HALP does not verify all listing information, endorse specific properties, or guarantee availability or pricing.

Information may contain errors, become outdated, or change. Always verify critical information — prices, availability, land sizes, and school catchments — directly with the property provider and the relevant education department.

6. Business Directory Listings

Advertisers must hold a valid ABN/ACN, be a legitimate operating business, and comply with applicable laws. Listings must be accurate, use your own name/logo, comply with Australian Consumer Law, and not contain misleading claims. Free and premium subscription tiers exist; premium subscriptions auto-renew unless cancelled. We may remove listings for breach, credible complaints, non-payment, or unlicensed operation.

7. Payment Terms (Advertiser Subscriptions)

All fees are in AUD, exclusive of GST unless stated. Payments are processed via Stripe. Subscriptions auto-renew unless cancelled. You may cancel anytime before the next billing date; no refunds for voluntary cancellations. Pro-rata refunds apply for technical issues preventing access, processed within 14 business days. Non-payment may result in suspension after 7 days and removal after 14 days.

8. Intellectual Property Rights

All content and materials on our platforms are owned by HALP or licensed to us, including logos, trademarks, design, software, text, graphics, and data compilations. We grant a limited, non-exclusive, revocable licence for personal, non-commercial use. User-generated content remains yours, but you grant HALP a worldwide, royalty-free licence to use, reproduce, modify and display it.

9. Disclaimers and Limitations

HALP does not provide financial, mortgage, investment, legal, tax, or real estate advice. Calculators are estimates only. We do not control the conduct of third parties or guarantee the quality of third-party services. Information may contain errors or become outdated. We do not guarantee continuous availability, error-free operation, or absence of malicious code.

10. Limitation of Liability

To the maximum extent permitted by law, HALP excludes liability for direct, indirect, consequential, and incidental damages. Where liability cannot be excluded, our total liability is capped at $100 AUD for free services, or the lesser of the amount you paid in the prior 12 months or $1,000 AUD for paid services. Nothing excludes rights under the Australian Consumer Law. You agree to indemnify HALP against claims arising from your breach of the Terms.

11. Dispute Resolution

Before legal action, contact legal@halp.com.au and allow 30 days for informal resolution. These Terms are governed by the laws of New South Wales, Australia, with exclusive jurisdiction of NSW courts. Optional arbitration in Sydney under ADRA rules is available. Class actions are waived to the extent permitted by law.

12. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement. If any provision is invalid, the remainder continues in force. You may not assign these Terms without our consent. Notices to us: legal@halp.com.au or 235 Glen Huntly Road, Elsternwick VIC 3185.

13. Special Terms

Mortgage calculators provide estimates only, not pre-approvals. School zone data is provided for research purposes; verify with education departments and schools. Property alerts are sent based on your saved criteria and can be modified anytime. Home loan referrals may generate a fee or commission for HALP; brokers are independent and licensed.
